These Terms of Service (“Terms”) apply when you use Scurry, including the Scurry website, URL shortening service, UTM builder and related services.
Scurry is a NeoOrbit project. NeoOrbit is a trading name of Clear Solutions Online Ltd, a company registered in England and Wales under company number 13779387.
By creating an account or using Scurry, you agree to these Terms.
1. Using Scurry
Scurry provides tools for creating and managing shortened URLs, tracking link activity, building campaign URLs and related features.
You must create an account to use our URL shortening service. You are responsible for keeping your account details and password secure and for activity carried out through your account.
You must provide accurate information when creating and maintaining your account.
You may use Scurry for personal or business purposes, provided that your use complies with these Terms and applicable law.
2. Your links
You are responsible for the links you create using Scurry and for ensuring that your use of the service is lawful.
Scurry does not create, endorse or control the websites, content or services that users choose to link to. We do not routinely review or monitor the destination of links created through the service.
You must not use Scurry to:
- link to or promote illegal content or activity;
- distribute malware, viruses or other harmful software;
- conduct phishing, fraud, scams or other deceptive activity;
- send spam or facilitate unsolicited bulk messaging;
- impersonate another person, organisation or business;
- infringe intellectual property, privacy or other rights belonging to another person;
- attempt to interfere with, damage or gain unauthorised access to Scurry or its systems;
- deliberately circumvent usage limits or restrictions; or
- use the service in any other unlawful, abusive or harmful way.
We may disable a link, custom domain or account if we reasonably believe it breaches these Terms, is unlawful, creates a security risk, or could cause harm to Scurry, our users or third parties.
If we become aware of potentially unlawful or abusive use of Scurry, we may investigate and take appropriate action. This may include disabling links or accounts and, where appropriate or legally required, cooperating with relevant authorities.
3. Custom domains
Some Scurry plans allow you to use your own domain or subdomain for shortened links.
You are responsible for ensuring that you have the right to use any domain you connect to Scurry and for correctly configuring the DNS records we provide.
We are not responsible for problems caused by your domain registrar, DNS provider, incorrect DNS configuration, expiration or suspension of your domain, or other services outside our control.
4. Free and paid plans
Scurry may offer both free and paid plans. The features, usage limits and prices applicable to each plan will be shown on our website or within your account.
We may change our plans, features, limits or prices from time to time. Changes to the price of an existing paid subscription will not take effect until we have given you reasonable notice.
5. Subscriptions and payments
Paid subscriptions are available on a recurring monthly or annual basis and are processed by Stripe.
Unless you cancel, your subscription will automatically renew at the end of each billing period and the applicable subscription fee will be charged using your selected payment method.
You can cancel a paid subscription at any time. We do not charge cancellation fees.
Your paid features will normally remain available until the end of the period you have already paid for. After this, your account will be moved to the applicable free plan or otherwise limited as explained when you cancel.
Payments are generally non-refundable once a billing period has started, except where required by law. We may consider refund requests on a case-by-case basis. Nothing in these Terms affects any statutory rights you may have as a consumer.
6. Usage limits
Plans may include limits on features such as the number of shortened links, tracked clicks, custom domains, analytics or other functionality.
You must not deliberately attempt to bypass these limits.
If you exceed the limits of your plan, we may restrict the relevant feature, ask you to upgrade or take other reasonable steps to enforce the applicable limits.
7. Availability of the service
We aim to keep Scurry reliable and available, but we do not guarantee that the service or any shortened URL will always be available, uninterrupted or error-free.
We may occasionally need to suspend or restrict parts of the service for maintenance, security, technical or operational reasons.
We may also add, change or remove features as Scurry develops.
You should not rely on Scurry as the sole means of accessing or preserving important information.
8. Closing or suspending accounts
You may stop using Scurry and close your account in accordance with the options available within the service.
We may suspend, restrict or close an account where we reasonably believe that:
- these Terms have been seriously or repeatedly breached;
- the account is being used unlawfully or fraudulently;
- its use creates a security risk or risks harm to Scurry or others; or
- we are required to do so by law.
Where reasonably possible, we will try to give you notice before closing an account, unless the circumstances require us to act immediately.
9. Intellectual property
Scurry and its software, branding, design and original content belong to Clear Solutions Online Ltd or its licensors and are protected by applicable intellectual property laws.
Using Scurry does not give you ownership of our software, branding or other intellectual property. You retain ownership of information and content that belongs to you.
10. Third-party services
Scurry relies on third-party providers to operate parts of the service, including services such as payment processing, hosting and internet infrastructure.
We are not responsible for failures or interruptions caused by third-party services outside our reasonable control.
Links created through Scurry may lead to third-party websites. We are not responsible for the content, availability, security, products or services provided by those websites.
11. Our liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
To the extent permitted by law, we are not responsible for indirect or consequential losses arising from your use of Scurry, or for losses caused by circumstances outside our reasonable control.
If you use Scurry for business purposes, we are not responsible for loss of profits, revenue, business, anticipated savings, goodwill or business opportunities arising from your use of the service.
If you are a consumer, nothing in these Terms limits the legal rights and remedies available to you under applicable consumer law.
12. Changes to these Terms
We may update these Terms occasionally to reflect changes to Scurry, our business or applicable law.
If we make a significant change that materially affects your rights, we will take reasonable steps to let you know.
The latest version of these Terms will always be available on our website.
13. Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer living outside England and Wales, you may also have rights under the mandatory laws of the country where you live. Nothing in these Terms is intended to remove rights that cannot legally be excluded.
